CareDial simplifies calling, but it does not replace the iPhone, your carrier, or emergency services.
The App helps set up photo contacts and start calls. You are responsible for the contacts, numbers, consent, device readiness, and emergency judgment involved in using it. Version 1.0 is free.

Agreement
These Terms of Use (the “Terms”) apply to your download, installation, and use of the CareDial Photo Phone mobile app for iOS (the “App”), published by Neon Summit LLC (“Neon Summit,” “we,” “us,” or “our”). They cover version 1.0 of the App.
What CareDial Is — and Is Not
CareDial is a simplified dialing interface. It helps a person place phone calls to contacts a family member has set up, and to a designated emergency contact via the SOS button.
- The SOS button calls the contact you configured. It does not contact 911 dispatch, emergency services, or any monitoring center on its own.
- Calls depend on the device, its phone service, signal coverage, and battery. CareDial cannot guarantee that any call, including an SOS call, will connect.
- Do not rely on CareDial as the sole means of summoning help in an emergency.
Apple and the App Store
These Terms are between you and Neon Summit only, and not with Apple Inc. (“Apple”). Neon Summit, not Apple, is responsible for the App and its content. Your use of the App must comply with the Apple App Store terms and usage rules that apply when you use it.
Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right to enforce these Terms against you as a third-party beneficiary.
Your Responsibilities
- Keep the device’s phone service active; CareDial cannot place calls without it.
- Verify that the numbers you enter — especially the SOS contact — are correct and current.
- Keep the Lock Mode PIN somewhere the responsible family member can find; Neon Summit LLC cannot recover contacts or settings from a device.
- Only enter contact names, phone numbers, and photos that you have the right and permission to use.
Price
CareDial version 1.0 is free. There are no subscriptions and no in-app purchases. If paid features are offered in the future, their price and terms will be shown clearly in the App before any purchase, and any billing will be handled through the Apple App Store.
Prohibited Use
You agree that you will not:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where applicable law prohibits that restriction.
- Rent, lease, lend, sell, redistribute, or sublicense the App, except as Apple’s standard App Store license expressly allows.
- Use the App to violate law, invade privacy, harass others, enter contact data without permission, or misrepresent its emergency behavior.
- Use the App for medical monitoring, emergency dispatch, unlawful surveillance, or any activity that could harm Neon Summit, users, caregivers, Apple, carriers, or emergency services.
Intellectual Property
The App, its design, and its content are the property of Neon Summit LLC. You may not copy, modify, or redistribute the App except as permitted by Apple’s standard App Store license (EULA). All rights not expressly granted are reserved by Neon Summit and its licensors.
Privacy
Your use of the App is also governed by the CareDial Privacy Policy, which explains how the App handles the contacts, photos, and settings you keep on the device. Please review it at /privacy/caredial.
Updates, Availability, and Support
We may update, modify, suspend, or discontinue the App or any feature at any time, including to fix defects, address security issues, comply with law or Apple requirements, or change product direction.
Support is available by email at support@neonsummit.co. We do not guarantee a particular response time, and support does not replace emergency services, medical advice, legal advice, or carrier support.
Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or able to complete any particular call, including an SOS call.
Limitation of Liability
To the maximum extent permitted by law, Neon Summit LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the App, including missed or failed calls. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where consumer-protection laws require another result. Nothing in this section affects any mandatory statutory rights you have as a consumer in your country of residence.
Changes to These Terms
We may update these Terms; the current version will always be posted on this page with its effective date. Continued use of the App after a change takes effect means acceptance.
